Chapter5 The Constitution of Nine Nations



Devidation of Powers and Functions
On the highest level in an ideal size big nation there remain four types of functions –
A.   Serving as the Supreme head of the nation
B.   Legislature function (making laws and regulations for land)
C.   Execution/Administration/ government/finance
D.   Judicial function.
The previous authors consider only the later three functions but in an ideal size nation, remaining as a head of state is a separate function from other three.



The Supreme Legislator- The Parliament –

The function of making law for the land  lie with the body of persons called the parliament. And this parliament comprise of  two houses-the upper  house and the lower house.

The upper house –
The members of upper house will only once be selected by the system(any governing body or people) and then those members will remain as members upto the age of 60. After that upto eternity a member only will decide that who will be his heir respectively on that seat of first house

The lower house –
Whole Nation will be divided into districts of size hundred km by hundred km(100km by 100km).Every district will send one Member to the lower house regardless of its population. There will be general elections after every five years for the making  of  second House of  Parliament  in which all adult citizens of a nation will cast their votes in their respective district for electing representative member of their district in the second house.






A) The Head of the nation – The Emperor

It should be a dynastic post. Thus an emperor will remain an emperor unto the age of 60 years and only he decides that who will become his successor. He could be removed by impeachment only. Yet all the powers lie in him but for a Democratic system it is very necessary that he should use his powers in emergency only. But there are some features which can’t be alienated from the Emperor at any part of time. These features are -

1)    He is the head of the Nation
2)    He is the symbol of Integrity and sovereignty of nation.
3)    He is the caretaker of the National Language- He take cares that all the education of all subjects take place in national language and that the syllabus should remain same all over the nation. And that no different dialects grow in different parts of nation.
4)    He is the Head of the Election Commission.
5)    He is the Joint Head of the Military of Nation along with President.
6)    Emergency powers – In a democracy it is very necessary that a dynastic Emperor exercise his powers only in the absence of a chief executive or a chief legislature otherwise not. And head of a state should not do the function of supreme executive, supreme legislature or supreme Judiciary. As a person he is the highest in the nation but there are collections of persons who are more powerful than him when it comes to legislature and governance functions


B) Vice president/ Vashishth/head of upper house
   The Upper house of parliament will elect its head from among its members. He will also be the chairman and speaker of upper house. He will be the vice president of Nation. In India he will be also called as Vashishth. He will have no role in government except emergency.


C) The Supreme Governor/the Supreme Executive– The Prime Minister

There should be an elected person which should run the government of the nation according to the laws of the nation generally called the constitution. This function is called governance. The governance could be done only with the help of a large number of persons who work in a hierarchical order. And the person who is at the top of this hierarchy is called Supreme Executive. And normally a Supreme executive should have all financial authorities also.

The election of the Prime Minister –Indirect Election by the people -

i) After every general elections in a nation there will be an election for Prime Minister of  Nation  in which members of only second house of parliament will vote .
iii) The contender of the election could be a member of any political party or could be an independent candidate.
iii) Once elected as president he could be removed only through impeachment.


Why is it necessary that Prime Minister could be removed by impeachment only -
i) Otherwise the Prime Minister will remain under unfair pressure of MPs who will try to blackmail him or remove him just to fulfill their personal causes.
ii) Otherwise he will have to waste valuable time in managing his ministers and MPs while he should use that valuable time over the problems of national importance.

D) The Supreme Judge
The Judiciary should be separate from the other three functionaries. The apex person in the judiciary will be called Supreme Judge.

The word - "Supreme"
The word Supreme should be copyrighted by the governments and it could not be used with any head of any state government, or any social or business organization. This word is the part of the title of only 4 persons in the nation. But writers could use this word with any non worldly or fictions personality.
